Plaintiff-appellant, Meredith, brought a diversity action against defendant-appellee, Rockwell International Corporation, for breach of an employment contract in the United States District Court for the Northern District of Ohio. Rockwell International asserted as a defense that Meredith had not, as required by Rule 19, F.R.Civ.P. joined as a party defendant Rockwell Canada, which is a Canadian corporation and a subsidiary of Rockwell International. Meredith then joined Rockwell Canada as a defendant. The district court thereupon dismissed the action for lack of complete diversity upon its finding that Meredith and Rockwell Canada were citizens of Canada.
